SALE OF YACHT “S/Y NOSTROMO”
PUBLIC AUCTION
Consequent to the order of the Commercial High Court of the Republic of Sri Lanka, holden in Colombo, in the Exercise of its Admiralty jurisdiction in Action in Rem No. 09/2022 “S/Y NOSTROMO” Year Built -1951 and re-built 2013, LOA/Extreme Breadth – 29 m/ 6.3 m, Hull – Steel, GT/NT–100/80 now at the Port of Galle, will be sold in it’s existing state/condition by public Auction free of all encumbrances on 05th September 2024 at 02.00 P.M at the premises of the Commercial High Court of Colombo Hall No 03 situated at Hulftsdorp Street, Colombo 12, Sri Lanka, by the Marshal of the Admiralty Court.
All prospective bidders will be required to deposit with the Marshal a sum of United States Dollars Ten Thousand (US $ 10,000.00) each before the commencement of the Auction by a Bank Draft drawn in favour of the “Judge of the Commercial High Court, Account No; 176100139026426” in order to become eligible to take part and make bids at the Auction. The bidding will be in multiples of US $ 5,000.00. The successful bidder is required to deposit the balance bid amount in United States Dollars within 14 days of the date of award into Judge of the Commercial High Court, Account No; 176100139026426” with the People’s Bank, Mid City Branch. The deposit of US $ 10,000.00 will be forfeited if the successful bidder fails to deposit the balance bid amount as set forth above. Time is of the essence of the contract and no extension of time will be granted under any circumstances whatsoever.
The offer for sale of the “S/Y NOSTROMO” is in it’s existing condition “as it is” and it shall be deemed that all bidders have inspected and examined the said Yacht. No subsequent complaints of any nature will be entertained.
In the event of the highest bidder failing to complete the purchase within the stipulated time, then the next highest bidder, in the respective order, may be called upon to deposit the balance amount of their bid and complete the purchase as set forth above, if their bid is accepted by Court. Deposit of unsuccessful bidders will be refunded within 30 days of the completion of sale of the Yacht.
All bids will be subject to the final approval of the Commercial High Court.
